There's no understanding law as good as the understanding you can get from understanding the people and the stories that are central to the case -- ProCD v. Zeidenberg

Here is a very interesting interview with Matt Zeidenberg and his lawyer, David Austin, regarding the background to ProCD v. Zeidenberg, the prominent 7th Circuit case that enforced a "shrinkwrap" license Zeidenberg did not encounter until after he opened the CD containing the program he had purchased. I had never realized before that the shrinkwrap license the court enforced conferred upon ProCD right to payment for factual information that it had appropriated from other sources. It had been able to appropriate that information because factual information cannot be copyrighted.
